LIZENZBESTIMMUNGEN (FÜR DEN PRIVATEN EINSATZ)
Diese Software ist für den privaten Einsatz generell kostenfrei. Sie dürfen die Software im Rahmen der privaten Nutzung auf beliebig vielen Computern uneingeschrängt nutzen solange Sie möchten.

LIZENZBESTIMMUNGEN (FÜR DEN KOMMERZIELLEN ODER BERUFLICHEN EINSATZ)
Für den kommerziellen, gewerblichen oder beruflichen Einsatz dieser Software müssen Sie nach einer freien Testperiode von maximal dreißig (30) Tagen, eine kostenpflichtige Softwarelizenz von 7-PDF, Germany - Thorsten Hodes für die Nutzung der Software erwerben. Wenn Sie die Software nach Ablauf dieser Testperiode nicht lizensieren, müssen Sie die Software entfernen. Sie darf dann nicht mehr weiterbenutzt werden. Eine Nutzung der Software über diese einmalig gewährte Testphase hinaus ist nur nach ausdrücklicher schriftlicher Genehmigung durch 7-PDF, Germany Thorsten Hodes möglich.

Mit Erwerb einer Softwarelizenz räumt Ihnen 7-PDF, Germany - Thorsten Hodes ein nicht exklusives und nicht übertragbares Recht (= begrenzte Lizenz) ein, die Software folgendermaßen zu nutzen:

a) Sie können die Software auf einem (1) Computer installieren, es sei denn, Sie haben Mehrfachlizenzen erworben. Durch den Erwerb von Mehrfachlizenzen, können Sie die Software auf vereinbarten "n" Computern installieren, wobei "n" der Anzahl der erworbenen Softwarelizenzen entspricht. 

b) Sie dürfen die Software auch mit Ihren eigenen kommerziellen Anwendungen verbreiten, allerdings erfordert dies den vorherigen Erwerb einer "Redistribution - Lizenz" für die Software.

c) Generell stehen Ihnen neben Einzel- und Mehrfachlizenzen, unter anderem Lizenzmodelle für Schulen, Studenten, Entwickler, Konzerne, Organisationen und Mittelstandsunternehmen zur Verfügung.

Weitere Informationen zu den aktuell verfügbaren Lizenzmodellen finden Sie hierzu auf unserer Website unter www.7-pdf.de.  Lizenzen können jederzeit über unsere Herstellerwebsite www.7-pdf.de beziehungsweise über Lizenzdistributoren, wie beispielsweise shareIt.com (Digital Rivers), erworben werden.

ALLGEMEINE LIZENZBESCHRÄNKUNGEN
Sie dürfen die Software unter folgenden Bedingungen benutzen und weitergeben:

  • Jede Änderung am Programm und der Dokumentation ist verboten. 
  • Sie müssen alle Dateien weitergeben, die auch im Originalpaket enthalten sind. 
  • Sie dürfen die Software nicht decompilieren oder in anderer Art den Programmcode wieder lesbar machen.
  • Sie dürfen die Software nicht verkaufen oder für die Weitergabe irgendeine Gegenleistung / Geld verlangen (außer Kosten für Datenträger). 
  • Sie haben die Lizenz, sowie die folgenden Garantiebestimmungen und den Haftungsausschluss gelesen, und sind damit einverstanden. 
  • Sie dürfen die Software auch als Teil eines Softwarepaketes weitergeben solange die für Sie gültigen Lizenzbestimmungen eingehalten werden. Sie brauchen keine vorherige Erlaubnis für dieser Art von Weitergabe.

TECHNISCHER SUPPORTANSPRUCH
Wenn Sie keinen Supportvertrag mit 7-PDF, Germany - Thorsten Hodes abgeschlossen haben, besteht keinerlei Anspruch auf technischen Support für die Nutzungsdauer der Software.

GARANTIE
Die Software und Dokumentation werden ohne jede Garantie angeboten. 7-PDF, Germany - Thorsten Hodes gibt keine ausdrücklichen oder stillschweigenden Garantien, einschließlich aber nicht beschränkt auf Garantien über Aussehen, Marktüblichkeit oder Verwendbarkeit für einen bestimmten Zweck. 7-PDF, Germany - Thorsten Hodes garantiert weder, dass die Funktionen der Software Ihren Anforderungen entsprechen, noch dass die Software fehlerfrei ist und ohne Unterbrechungen funktioniert, noch dass Fehler in der Software oder Dokumentation behoben werden.

HAFTUNG
Unter keinen Umständen (eingeschlossen Fahrlässigkeit) ist 7-PDF, Germany - Thorsten Hodes haftbar für Einkommensverlust oder Schäden jeglicher Art die durch den Einsatz oder fehlender Möglichkeit zum Einsatz des Produktes oder der Dokumentation entstehen könnten. Dies gilt auch, wenn 7-PDF, Germany - Thorsten Hodes über die Möglichkeit des Auftretens solcher Fälle informiert wurde. Einige Staaten erlauben die Einschränkung von Garantien bzw. den Ausschluss von Haftung nicht, in diesen Fällen trifft die Einschränkung der Garantie bzw. der Haftungsausschluss für Sie nicht zu. Eventuelle Schadensersatzansprüche bleiben dann auf die Höhe der evtl. entrichteten Lizenzgebühr beschränkt.

Der Sourcecode dieser Software ist nicht öffentlich verfügbar.

GENERELLE INFORMATION
Diese Software dürfte einen Postscript zu PDF Konverter wie Ghostscript benutzen. Diese Lizenz deckt nicht die Distribution derartiger Konverter ab. Sie sollten zu Kenntnis nehmen das diese Postscript zu PDF Konverter jeweils eigenen Lizenz-bestimmungen unterliegen, welche ausdrücklich nicht auf diese Software übertragbar sind.

ANWENDBARES RECHT, GERICHTSSTAND, SALVATORISCHE KLAUSEL

a. Für diese EULA gilt das Recht der Bundesrepublik Deutschland.

b. Soweit Sie Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen sind, soll Frankfurt am Main ausschließlicher Gerichtsstand für alle sich aus dem EULA unmittelbar oder mittelbar ergebenden Streitigkeiten sein. Die Gerichtssprache und die Sprache in außergerichtlichen Streitbeilegungsverfahren ist Deutsch.

c. Sollte eine Bestimmung in diesem EULA unwirksam sein oder werden, so wird dadurch der Bestand dieses EULA oder die unter Zugrundelegung dieses EULA geschlossenen Verträge im Übrigen nicht berührt. An die Stelle der unwirksamen Bestimmung tritt eine wirksame Bestimmung, die dem wirtschaftlichen Sinn der unwirksamen Bestimmung am nächsten kommt.

ÄNDERUNG DER EULA
Wir behalten uns das Recht vor, unsere EULA jederzeit ohne Nennung von Gründen zu ändern, es sei denn, dass dies für den Nutzer nicht zumutbar ist.

BY INSTALLING THIS SOFTWARE, YOU ACCEPT ALL REQUIREMENTS AND CONDITIONS OF THIS LICENCE AGREEMENT AND CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THIS EULA. LICENCING CONDITIONS (FOR PRIVATE USE)
This software is generally available free of charge for private use. You are entitled to the unlimited use of the software within the scope of private use on any number of computers and for an unlimited period of time.

LICENCING CONDITIONS (FOR COMMERCIAL OR PROFESSIONAL USE)
In the case of commercial, industrial or professional use, you are required to purchase a software licence from 7-PDF, Germany - Thorsten Hodes for the use of the software following a free test period of no more than thirty (30) working days. If you do not purchase a licence for the software after this test period, you must delete the software and it may no longer be used. The use of the software after this single test period is only possible with the express written agreement of 7-PDF, Germany Thorsten Hodes.

Following the purchase of a software licence, 7-PDF, Germany Thorsten Hodes grants you a non-exclusive and non transferable right (=limited licence) to use the software as follows:

a) You may install the software on one (1) computer, unless you have purchased multiple licences. By purchasing multiple licences, you are permitted to install the software on "n" computers in accordance with the agreement, whereby "n" is the number of purchased software licences.

b) You are also permitted to distribute the software with your own commercial applications, although this is subject to the prior acquisition of a "redistribution licence" for the software.

c) In general, licence models for schools, students, developers, companies, organisations and medium-sized companies are also available in addition to the individual and multiple licences.

Additional information about the licence models currently available can be found on our website www.7-pdf.de.  Licences can be purchased from our manufacturer?s website www.7-pdf.de and licence distributors, such as shareIt.com (Digital Rivers), at any time.

GENERAL LICENCING RESTRICTIONS
You are permitted to use and distribute the software in accordance with the following conditions: 

  • Changes to the program and the documentation are prohibited. 
  • You must pass on all files included in the original pack. 
  • You are not permitted to decompile the software or make the program code legible in any other way.
  • You are not permitted to sell the software or demand any other form of counter-performance/payment for redistribution (apart from the cost of data carriers). 
  • You have read and agreed with the licence, the following warranty provisions and the disclaimer. 
  • You are also permitted to redistribute the software as part of a software package as long as the applicable licence conditions are adhered to. You are not required to obtain prior permission for this type of redistribution.

TECHNICAL SUPPORT ENTITLEMENT
If you have not concluded a support contract with 7-PDF, Germany - Thorsten Hodes, you are not entitled to any technical support for the duration of the software use.

WARRANTY
The software and documentation are provided with no warranty of any kind. 7-PDF, Germany - Thorsten Hodes provides no express or tacit warranties, including but not limited to warranties regarding appearance, standard market features or appropriateness for a specific purpose. 7-PDF, Germany - Thorsten Hodes does not guarantee that the software will function in accordance with your requirements, that the software is free of faults, that it will function with no interruptions or that faults in the software or documentation will be rectified.

LIABILITY
7-PDF, Germany - Thorsten Hodes is not liable under any circumstance for the loss of income or incurred damages of any kind which may result from the use or lack of opportunity to use the product or documentation. This also applies even if 7-PDF, Germany - Thorsten Hodes has been informed of the possibility that such situations may occur. Certain countries do not permit the limitation of warranties or the exclusion of liability. In such cases, the restricted warranty or exclusion of liability do not apply. Any claims for compensation in such cases are limited to the level of the licence fee which may have been paid.

COPYRIGHT
The software is NOT public domain software. The copyright and all ownership rights to the software remain the property of 7-PDF, Germany - Thorsten Hodes. 

SOURCE CODE
The source code for this software is not publically available.

GENERAL INFORMATION
This software can use Postscript to PDF converters, such as Ghostscript. This licence does not include the distribution of these types of converter. Please note that these Postscript to PDF converters are each subject to their own licence provisions, which are expressly not transferrable to this software. 

APPLICABLE LAW, LEGAL VENUE, SEVERABILITY CLAUSE

a. The law of the Federal Republic of Germany applies to this EULA. 

b. If you are a retailer, corporate body under public law or special fund under public law, Frankfurt am Main in Germany is the exclusive legal venue for all disputes directly or indirectly arising from the EULA. The official language used in court and the language in extrajudicial dispute settlements is German.

c. If a provision of this EULA is or becomes ineffective, this shall not affect the existence of this EULA or the contracts concluded on the basis of this EULA. An effective provision which most closely reflects the economic purpose of the ineffective provision shall replace this ineffective provision. 

AMENDMENTS TO THE EULA
We reserve the right to amend our EULA at any time without providing reasons, unless this is considered unreasonable for the user.
